Dear Mr. Rai:

I am an American Citizen and I have received a Notice of Approval from INS of my fiancee. Will I be required to file Affidavit of Support? There are two kinds of Affidavit of Support Forms. What is the difference between them and what are the supporting documents required with these forms?

Dear Mr. Kalkat:

There are two types of forms; one is for non-immigrant visas like Visitor, Business, Student, fiancee or any kind of temporary visa. The fiancee Visa is considered as a non-immigrant visa and you should complete Affidavit of Support Form I-134 to your fiancee along with your job letter and bank letter. The purpose of this is to prove that your have sufficient funds to provide financial support during his or her stay in the United States.

The second type of Affidavit of Support Form I-864 is required for all kinds of Immigrant Visas. Your fiancee will enter the United States on a fiancee Visa (K-1) and after marriage you will apply for her adjustment of status as a Permanent Resident. With the application for adjustment of status you have to complete Form I-864. Following are the supporting documents required with Form I-864.

  • Income Tax Returns for the last three years.
  • Job letter showing your income.
  • Bank letter indicating your current bank balance.

If you are currently employed and your household income for your household size is equal to or greater than the applicable poverty line requirement, you do not need to list assets on Form I-864. The current 1999 Poverty Guidelines are:

I believe you come under the 125% Poverty Line. If your income is below the above mentioned poverty line then you can get additional Affidavit of Support Form I-1864 from any other family member, friend or relative.

Dear Mr. Ismail:

Applying for Immigration as an Investor is very complicated. The basic requirement is to invest quarter million to a million dollars and within certain period you have to provide gainful employment to at least 10 residents or citizens. I suggest you consult a reputable Immigration Attorney to deal with your case.
